Comment: One commenter suggested we allow non-CCHIT<br />

certified EHRs to submit data to PQRI.<br />

Response: We are not planning to accept data via EHRs<br />

for purposes of satisfactorily reporting data on quality<br />

measures in the 2009 PQRI and instead will only continue<br />

testing in the 2009 PQRI. We do not intend to limit<br />

testing to CCHIT certified EHRs given the fact that<br />

relevant certification standards may not yet have <strong>been</strong><br />

adopted. Any EHR quality data submission will be required<br />

to comply with all current regulations regarding security,<br />

privacy, and HIPAA.<br />

Comment: A few commenters suggested allowing EHRs to<br />

report quality measures data on measures groups.<br />

Response: We did not propose this option because of<br />

our concerns with the feasibility of such reporting. In<br />

addition, as discussed previously, we are not including EHR<br />

reporting for the 2009 PQRI as an option but instead will<br />

continue testing during 2009.<br />

Comment: A commenter was concerned that <strong>CMS</strong> does not<br />

inadvertently facilitate anti-competitive behavior by<br />

allowing reporting of information on quality measures via<br />

EHRs.<br />
