As discussed in section II.O1.b.ii. of this final rule<br />

with comment period, we are also establishing the three<br />

reporting options for registry-based submission of quality<br />

measures results and numerator and denominator data on PQRI<br />

measures groups summarized in Table 12.<br />

To report quality measures results and numerator and<br />

denominator data on quality measures or measures group<br />

through registries, eligible professionals will need to<br />

enter into and maintain an appropriate legal arrangement<br />

with an eligible clinical registry. As we described in the<br />

CY 2009 PFS proposed rule (73 FR 38562), such arrangements<br />

will provide for the registry’s receipt of patient-specific<br />

data from the eligible professional and the registry’s<br />

disclosure of quality measures results and numerator and<br />

denominator data on behalf of the eligible professional to<br />

<strong>CMS</strong> for the PQRI. Thus, the registry would act as a Health<br />

Insurance Portability and Accountability Act of 1996<br />

(Pub. L. 104-191) (HIPAA) Business Associate and agent of<br />

the eligible professional. Such agents are referred to as<br />

“data submission vendors.” Such “data submission vendors”<br />

would have the requisite legal authority to provide<br />

clinical registry data on behalf of the eligible<br />

professional to the Quality Reporting System developed in<br />

accordance with the statute. The registry, acting as such<br />
