speech-language pathologists, and qualified audiologists.<br />

In addition, section 1848(k)(2)(D) of the Act, as<br />

added by the MIPPA, requires that for each 2009 PQRI<br />

quality measure, “the Secretary shall ensure that eligible<br />

professionals have the opportunity to provide input during<br />

the development, endorsement, or selection of measures<br />

applicable to services they furnish.”<br />

Section 1848(m)(3)(A) of the Act, as amended and<br />

redesignated by the MIPPA, also requires that for years<br />

after 2008, the PQRI quality measures shall not include<br />

e-prescribing quality measures. Even with the removal of<br />

the e-prescribing measure, we continue to meet the<br />

requirements under section 1848(k)(2)(B)(ii) of the Act to<br />

include the use of structural measures.<br />

Section 131(b)(6)of the MIPPA also specifies that none<br />

of the amendments to the Social Security Act resulting from<br />

the MIPPA will impact the operation of the PQRI for 2007 or<br />

2008. Additional information regarding the MIPPA<br />

provisions can be found in section III. of this final rule<br />

with comment period.<br />
