<strong>CMS</strong>-1403-FC<br />

(Pub. L. 110-173) (MMSEA), authorizes “Transitional Bonus<br />

Incentive Payments for Quality Reporting” in 2007 and 2008,<br />

for satisfactory reporting of quality data, as defined by<br />

section 101(c)(2) of the MIEA-TRHCA. We have named this<br />

quality reporting system the “Physician Quality Reporting<br />

Initiative (PQRI)” for ease of reference.<br />

The MMSEA required the Secretary to establish<br />

alternative reporting periods and alternative criteria for<br />

satisfactorily submitting data on quality measures through<br />

medical registries and for reporting groups of measures for<br />

2008 and 2009.<br />

For 2009, section 1848(k)(2)(B)(ii) of the Act, as<br />

amended by the MMSEA, requires the Secretary to publish a<br />

proposed set of quality measures that would be appropriate<br />

for eligible professionals to use to submit data in 2009 in<br />

the Federal Register by August 15, 2008. Such measures<br />

shall be measures that have <strong>been</strong> endorsed or adopted by a<br />

consensus organization, such as the National Quality Forum<br />

(NQF) or the AQA (formerly the Ambulatory Care Quality<br />

Alliance), that include measures that have <strong>been</strong> <strong>submitted</strong><br />

by a physician specialty, and that the Secretary identifies<br />

as having used a consensus-based process for developing<br />

such measures. In addition, the measures shall include<br />

structural measures, such as the use of electronic health<br />
