a. Program Background and Statutory Authority<br />

i. Division B of the Tax Relief and Health Care Act of<br />

2006 – Medicare Improvements and Extension Act of 2006<br />

(MIEA-TRHCA) and the Medicare, Medicaid, and SCHIP<br />

Extension Act of 2007 (MMSEA): Requirements for the PQRI<br />

Program Prior to Enactment of the Medicare Improvements for<br />

Patients and Providers Act of 2008 (MIPPA)<br />

Section 101(b) of the MIEA-TRHCA (Pub. L. 109-432)<br />

amended section 1848 of the Act by adding subsection (k).<br />

Section 1848(k)(1) of the Act requires the Secretary to<br />

implement a system for the reporting by eligible<br />

professionals of data on quality measures as described in<br />

section 1848(k)(2) of the Act. Section 1848(k)(1) of the<br />

Act authorizes the Secretary to specify the form and manner<br />

for data submission by program instruction or otherwise<br />

which may include submission of such data on Part B claims.<br />

Section 1848(k)(3)(B) of the Act specifies that for the<br />

purpose of the quality reporting system, eligible<br />

professionals include physicians, other practitioners as<br />

described in section 1842(b)(18)(C) of the Act, physical<br />

and occupational therapists, and qualified speech-language<br />

pathologists. Section 101(c) of the MIEA-TRHCA, as amended<br />

by the Medicare, Medicaid, and SCHIP Extension Act of 2007<br />
