(in all instances other than temporary and transient<br />

network transmission failures), that most areas would have<br />

the telecommunication and/or Internet connectivity capacity<br />

to allow providers to conduct e-prescribing, and an<br />

exemption is not warranted in the rare instance where this<br />

may not be the case.<br />

Comment: We received feedback from 19 commenters who<br />

agreed with the proposal to extend the exemption to<br />

computer-generated facsimiles for the prescription refill<br />

request transaction in cases where the physician is not<br />

NCPDP SCRIPT enabled.<br />

Response: We agree with commenters. <strong>This</strong> issue will<br />

be resolved with this final rule's reversal of the CY 2008<br />

PFS final rule's e-prescribing provisions that would have<br />

eliminated the computer-generated faxing exemption (in all<br />

instances other than temporary and transient network<br />

transmission failures) effective on January 1, 2009, and<br />

concurrent reinstatement of the original exemption for<br />

computer-generated facsimiles from the November 7, 2005<br />

final rule effective January 1, 2009. However, we will<br />

eliminate the reinstated exemption for computer-generated<br />

facsimiles (in all instances other than transient/temporary<br />

network transmission failures) effective when the MIPPA<br />
