privileges; (2) Suspension or revocation of a license to<br />

furnish health care by any State licensing authority; (3)<br />

Revocation or suspension by an accreditation organization;<br />

(4) A conviction of a Federal or State felony offense (as<br />

defined in §424.535(a)(3)(i)) within the last 10 years<br />

preceding enrollment, revalidation, or re-enrollment; or<br />

(5) An exclusion or debarment from participation in a<br />

Federal or State health care program.<br />

5. Maintaining Ordering and Referring Documentation<br />

We proposed to add a new §424.516(f) that would<br />

specify, “A provider or supplier is required to maintain<br />

ordering and referring <strong>document</strong>ation, including the NPI,<br />

received from a physician or eligible NPP. Physicians and<br />

NPPs are required to maintain written ordering and<br />

referring <strong>document</strong>ation for 10 years from the date of<br />

service.” We believe that it is essential that providers<br />

and suppliers maintain <strong>document</strong>ation regarding the specific<br />

service ordered or referred to a Medicare beneficiary by a<br />

physician or NPP as defined in section 1842 (b)(18)(c) of<br />

the Act,(which includes but is not limited to nurse<br />

practitioners, and physician assistants). We believe that<br />

ordering and referring <strong>document</strong>ation maintained by a<br />

provider or supplier must match the information on the<br />

Medicare claims form. Additionally, we proposed to add<br />
