Response: <strong>This</strong> comment is outside the scope of the<br />

proposed rule and can not be addressed in this final rule.<br />

After reviewing public comments, we are finalizing the<br />

definition of “physician or nonphysician practitioner (NPP)<br />

organization" at §424.502 as “any physician or NPP<br />

organization that enrolls in the Medicare program as a sole<br />

proprietorship or any organizational entity.”<br />

Organizational entities include, but are not limited to,<br />

limited liability corporations, Subchapter S corporations,<br />

partnerships, professional limited liability corporations,<br />

professional corporations, and professional associations.<br />

After reviewing public comments, we are finalizing the<br />

provision at §424.520(d) to state that we will establish an<br />

effective date of billing for physicians, NPPs and<br />

physician and NPP organizations that would be the later of:<br />

(1) the date of filing of a Medicare enrollment application<br />

that was subsequently <strong>approved</strong> by Medicare contractor (that<br />

is, carrier, fiscal intermediary or A/B Medicare<br />

Administrative Contractor); or (2) the date a physician,<br />

NPP or physician and NPP organization first started<br />

furnishing services at its new practice location.<br />

In §424.521, Request for Payment by Physicians,<br />

Nonphysician Practitioners, Physician or Nonphysician<br />

Organizations, we are finalizing the proposals.<br />
