approach would address the situations where denial errors<br />

and clarifications can be corrected without delaying the<br />

effective date.<br />

Response: As a general rule, applicants are given at<br />

least 30 days to cure any deficiencies/technicalities<br />

before a contractor rejects an enrollment application (see<br />

§424.525). During the application review process,<br />

contractors notify applicants about missing information and<br />

<strong>document</strong>ation and afford the applicant at least 30 days to<br />

correct deficiencies. With the implementation of<br />

Internet-based PECOS, we expect that physicians and NPPs<br />

using the Web process will significantly decrease the<br />

number the number of incomplete applications and the need<br />

for contractors to request additional information. With<br />

the implementation of this final rule, we would require<br />

contactor to deny, rather than reject paper or Web<br />

applications when a physician, NPP, or physician or NPP<br />

organization fails to cure any deficiencies/technicalities.<br />

Comment: One commenter urged <strong>CMS</strong> to adopt a standard<br />

establishing that the filing date for an enrollment<br />

application is when a signed application is first received<br />

by a contractor and not when the application is deemed<br />

complete and ready for approval by that contractor.<br />
