follow-up inpatient consultations from the list of <strong>approved</strong><br />

telehealth services.<br />

In the CY 2008 PFS proposed rule (72 FR 38144) and<br />

subsequent final rule with comment period (72 FR 66250), we<br />

discussed a request we received from the ATA to add<br />

subsequent hospital care to the list of <strong>approved</strong> telehealth<br />

services. Because there is currently no method for<br />

practitioners to bill for follow-up inpatient consultations<br />

delivered via telehealth, the ATA requested that we approve<br />

use of the subsequent hospital care codes to bill follow-up<br />

inpatient consultations furnished via telehealth, as well<br />

as to bill for subsequent hospital care services furnished<br />

via telehealth that are related to the ongoing E/M of the<br />

hospital inpatient (72 FR 66250). Since the subsequent<br />

hospital care codes describe a broader range of services<br />

than follow-up inpatient consultation, including some<br />

services that may not be appropriate for addition to the<br />

list of telehealth services, we did not add subsequent<br />

hospital care to the list of <strong>approved</strong> telehealth services.<br />

Instead, we committed to continue to evaluate whether, and<br />

if so, by what mechanism subsequent hospital care could be<br />

<strong>approved</strong> for telehealth when used for follow-up inpatient<br />

consultations (72 FR 66249).<br />
