According to industry reports in 2006 approximately<br />

3.309 billion prescriptions 11 were filled by retail<br />

dispensers, and according to <strong>CMS</strong> data, in 2006,<br />

approximately 825,000,000 Part D claims (prescription drug<br />

events) were finalized and accepted for payment 12 , or<br />

approximately 25 percent of the total prescriptions filled<br />

that year. Thus, $130 million of the $520 million total<br />

loss estimated above would be attributable to Medicare Part<br />

D claims. We invite comments on these savings and loss<br />

assumptions estimates and assumptions.<br />

We also assume that expanding the computer-generated<br />

facsimile exception to allow for computer-generated faxing<br />

in instances in which the provider is incapable of<br />

receiving electronic refill request transactions using the<br />

NCPDP SCRIPT standard would result in improved patient<br />

satisfaction through timely prescription refill request<br />

authorizations from prescribers and maintenance of existing<br />

workflows at both the prescriber and dispenser ends.<br />

Our decision to retain the exemption for computer-<br />

generated facsimiles in all instances other than<br />

temporary/transient transmission failures will have a<br />

positive impact on the industry overall, including small<br />

pharmacies and prescribers who are early adopters of<br />
