section, at 273 - 302, the AMA includes both diagnostic<br />

imaging procedures (including diagnostic nuclear medicine),<br />

and therapeutic procedures. The radiology subsections are<br />

as follows: Diagnostic Radiology (Diagnostic Imaging) is<br />

comprised <strong>of</strong> CPT codes 70010 – 76499. Diagnostic Ultrasound<br />

is comprised <strong>of</strong> CPT codes 76506 – 76999. Radiation <strong>Oncology</strong><br />

is comprised <strong>of</strong> CPT codes 77261 – 77799. Nuclear Medicine<br />

(Diagnostic) is comprised <strong>of</strong> CPT codes 78000 – 78999, and<br />

Nuclear Medicine (Therapeutic) is comprised <strong>of</strong> CPT codes<br />

79005 – 79999.<br />

We also note that the Medicare statute places<br />

diagnostic nuclear medicine in the same category as<br />

diagnostic radiology for coverage and payment purposes.<br />

That is, we cover diagnostic nuclear medicine under our<br />

authority in section 1861(s)(3) <strong>of</strong> the Act, the same<br />

statutory section that authorizes coverage for diagnostic<br />

X-rays, CT scans, MRIs, and ultrasound services. In<br />

addition, section 1833(t) <strong>of</strong> the Act sets forth Medicare<br />

payment for “outpatient hospital radiology services<br />

(including diagnostic and therapeutic radiology, nuclear<br />

medicine and CAT scan procedures, magnetic resonance<br />

imaging, and ultrasound and other imaging services, but
