Section 303(e)(2) <strong>of</strong> the MMA added section 1842(o)(6)<br />

<strong>of</strong> the Act that requires the Secretary to pay a supplying<br />

<strong>fee</strong> (less applicable deductible and coinsurance) to<br />

pharmacies for certain Medicare Part B drugs and<br />

biologicals, as determined appropriate by the Secretary.<br />

The types <strong>of</strong> Medicare Part B drugs and biologicals eligible<br />

for a supplying <strong>fee</strong> are immunosuppressive drugs described in<br />

section 1861(s)(2)(J) <strong>of</strong> the Act, oral anticancer<br />

chemotherapeutic drugs described in section 1861(s)(2)(Q) <strong>of</strong><br />

the Act, and oral anti-emetic drugs used as part <strong>of</strong> an<br />

anticancer chemotherapeutic regimen described in section<br />

1861(s)(2)(T) <strong>of</strong> the Act.<br />

Beginning with CY 2005, we established a supplying <strong>fee</strong><br />

<strong>of</strong> $24 per prescription for these categories <strong>of</strong> drugs, with<br />

a higher <strong>fee</strong> <strong>of</strong> $50 for the initial oral immunosuppressive<br />

prescription supplied in the first month after a transplant.<br />
