4. Proposed Revisions to §413.170 (Scope) and §413.174<br />

(Prospective rates for hospital-based and independent ESRD<br />

facilities)<br />

Under section 623 <strong>of</strong> the MMA, we propose to revise<br />

§413.170(b) to specify that this subpart provides procedures<br />

and criteria under which only a pediatric facility may<br />

receive an exception.<br />

Also under section 623 <strong>of</strong> the MMA, we propose to revise<br />

§413.174 to reflect the changes in the additional payment<br />

for separately billable drugs.<br />

5. Proposed Revisions to the Composite Payment Rate<br />

Exceptions Process<br />

The current regulations at §413.180 through §413.192<br />

contain the procedures for requesting exceptions to ESRD<br />

facility composite payment rates, and establish five<br />

criteria for approval <strong>of</strong> exception requests. The five<br />

criteria are as follows:<br />

● Atypical service intensity (§413.184).<br />

● Isolated essential facility (§413.186).
