(3) Die Mitgliedstaaten gewähren jedem Steuerpflichtigen<br />
darüber hinaus den Abzug o<strong>der</strong> die Erstattung<br />
<strong>der</strong> in Absatz 2 genannten Mehrwertsteuer,<br />
soweit die Gegenstände und Dienstleistungen verwendet<br />
werden für Zwecke :<br />
a) seiner Umsätze, die sich aus den im Ausland ausgeübten<br />
wirtschaftlichen Tätigkeiten im Sinne des<br />
Artikels 4 Absatz 2 ergeben, für die das Recht auf<br />
Vorsteuerabzug bestünde, wenn diese Umsätze im<br />
Inland bewirkt worden wären;<br />
b) seiner nach Artikel 14 Absatz 1 Buchstabe i, Artikel<br />
15, Artikel 16 Absatz 1 Teile B, C, D und E und<br />
Absatz 2 sowie Artikel 28c Teil A und C befreiten<br />
Umsätze;<br />
c) seiner nach Artikel 13 Teil B Buchstaben a und d<br />
Nummern 1 bis 5 befreiten Umsätze, wenn <strong>der</strong> Leistungsempfänger<br />
außerhalb <strong>der</strong> Gemeinschaft ansässig<br />
ist o<strong>der</strong> wenn diese Umsätze unmittelbar mit zur<br />
Ausfuhr in ein Drittlandsgebiet bestimmten Gegenständen<br />
zusammenhängen.<br />
(4) Mehrwertsteuererstattungen nach Absatz 3 erfolgen<br />
- an nicht im Inland , son<strong>der</strong>n in einem an<strong>der</strong>en Mitgliedstaat<br />
ansässige Steuerpflichtige entsprechend<br />
den in <strong>der</strong> Richtlinie 79/1072/EWG festgelegten<br />
Bestimmungen;<br />
- an nicht im Gebiet <strong>der</strong> Gemeinschaft ansässige<br />
Steuerpflichtige entsprechend den in Richtlinie<br />
86/560/EWG festgelegten Bestimmungen.<br />
Bei Anwendung dieser Vorschrift gilt folgendes:<br />
a) In Artikel 1 <strong>der</strong> Richtlinie 79/1072/EWG genannte<br />
Steuerpflichtige, die im Inland ausschließlich Lieferungen<br />
von Gegenständen und Dienstleistungen bewirken,<br />
für die gemäß Artikel 21 Nummer 1 Buchstabe<br />
a <strong>der</strong> Empfänger als Steuerschuldner bestimmt<br />
worden ist, gelten bei Anwendung <strong>der</strong> genannten<br />
Richtlinie ebenfalls als nicht im Inland ansässige<br />
Steuerpflichtige.<br />
b) In Artikel 1 <strong>der</strong> Richtlinie 86/560/EWG genannte<br />
Steuerpflichtige, die im Inland ausschließlich Lieferungen<br />
von Gegenständen und Dienstleistungen bewirken,<br />
für die gemäß Artikel 21 Nummer 1 Buchstabe<br />
a <strong>der</strong> Empfänger als Steuerschuldner bestimmt<br />
worden ist, gelten bei Anwendung dieser Richtlinie<br />
ebenfalls als nicht in <strong>der</strong> Gemeinschaft ansässige<br />
Steuerpflichtige.<br />
c) Die Richtlinien 79/1072/EWG und 86/560/EWG<br />
finden keine Anwendung auf die Lieferung von Gegenständen,<br />
die von <strong>der</strong> Steuer befreit sind o<strong>der</strong> gemäß<br />
Artikel 28c Teil A befreit werden könnten, wenn<br />
die gelieferten Gegenstände vom Erwerber o<strong>der</strong> für<br />
seine Rechnung versendet o<strong>der</strong> beför<strong>der</strong>t werden.<br />
(5) Soweit Gegenstände und Dienstleistungen von<br />
einem Steuerpflichtigen sowohl für Umsätze verwendet<br />
werden, für die nach den Absätzen 2 und 3 ein<br />
Recht auf Vorsteuerabzug besteht, als auch für Um-<br />
Indirekte Steuern<br />

3. Member States shall also grant to every taxable<br />
person the right to a deduction or refund of the value<br />
added tax referred to in paragraph 2 in so far as the<br />
goods and services are used for the purposes of:<br />
(a) transactions relating to the economic activities as<br />
referred to in Article 4 (2) carried out in another<br />
country, which would be eligible for deduction of tax<br />
if they had occurred in the territory of the country;<br />
(b) transactions which are exempt un<strong>der</strong> Article 14<br />
(1) (i) and un<strong>der</strong> Articles 15 and 16 (1) (B), (C) and<br />
(D), and paragraph 2;<br />
(c) any of the transactions exempted un<strong>der</strong> Article 13<br />
B (a) and (d), paragraphs 1 to 5, when the customer is<br />
established outside the Community or when these<br />
transactions are directly linked with goods intended<br />
to be exported to a country outside the Community.<br />
4. The refund of value added tax referred to in<br />
paragraph 3 shall be effected:<br />
- to taxable persons who are not established within<br />
the territory of the country but who are established in<br />
another Member State in accordance with the detailed<br />
implementing rules laid down in Directive<br />
79/1072/EEC<br />
- to taxable persons who are not established within<br />
the territory of the Community, in accordance with<br />
the detailed implementing rules laid down in<br />
Directive 86/560/EEC<br />
For the purposes of applying the above:<br />
(a) the taxable persons referred to in Article 1 of<br />
Directive 79/1072/EEC shall also be consi<strong>der</strong>ed for<br />
the purposes of applying the said Directive as taxable<br />
persons who are not established in the country when,<br />
inside the territory of the country, they have only<br />
carried out supplies of goods and services to a person<br />
who has been designated as the person liable to pay<br />
the tax in accordance with Article 21 (1) (a);<br />
(b) the taxable persons referred to in Article 1 of<br />
Directive 86/560/EEC shall also be consi<strong>der</strong>ed for the<br />
purposes of applying the said Directive as taxable<br />
persons who are not established in the Community<br />
when, inside the territory of the country, they have<br />
only carried out supplies of goods and services to a<br />
person who has been designated as the person liable<br />
to pay the tax in accordance with Article 21 (1) (a);<br />
(c) Directives 79/1072/EEC and 86/560/EEC shall<br />
not apply to supplies of goods which are, or may be,<br />
exempted un<strong>der</strong> Article 28c (A) when the goods<br />
supplied are dispatched or transported by the acquirer<br />
or for his account.<br />
5. As regards goods and services to be used by a<br />
taxable person both for transactions covered by<br />
paragraphs 2 and 3, in respect of which value added<br />
tax is deductible, and for transactions in respect of
