The changed or supplemented conditionsonly apply if the bidder submits a bid again afterreceiving the notice.(c) The EU Commission has provided a platform forhybrid dispute resolution (so-called “OS platform”). TheOS platform is intended to be used for out-of-court disputeresolution in the context of disputes arising fromhybrid contracts. The OS platform can be reached viathe following link: http://ec.europa.eu/consumers/odr.According to § 36 VSBG, we inform you that we areneither willing nor obliged to participate in a dispute settlementprocedure before a consumer arbitration board.(d) Should individual provisions of these GTC be orbecome invalid or unenforceable, the validity of theremainder of the contract shall remain unaffected. Thestatutory provisions shall take the place of the ineffectiveor unenforceable provision. The same applies accordinglyin the event that the contract proves to be incomplete.13. Right of WithdrawalRIGHT OF WITHDRAWAL:You have the right to withdraw from this contract withinfourteen days without giving any reason. The withdrawalperiod is fourteen days from the day on which you or athird party named by you who is not the carrier took possessionof the goods or, in the case of partial deliveries,the last delivery.In order to exercise your right of withdrawal, you mustinform the exhibitor specified in the purchase contract,who must be an entrepreneur, of your decision to withdrawfrom this contract by means of a clear statement(e.g., a letter sent by post, fax or e-mail). You can usethe attached sample revocation form for this. However,this is not mandatory.To meet the right of withdrawal deadline, it is sufficientfor you to send the communication regarding your exerciseof the right of cancellation before the cancellationperiod has expired.Consequences of revocationIf you revoke this contract, the respective exhibitor mustreimburse you for all payments that they have receivedfrom you immediately and at the latest within fourteendays from the day on which they received notification ofyour revocation of this contract. For this repayment, theyuse the same means of payment that you used in theoriginal transaction, unless something else was explicitlyagreed with you. Under no circumstances will you becharged any fees for this repayment. The exhibitor canrefuse the repayment until they have received the goodsback or until you have provided proof that you have sentback the goods, whichever is earlier.You must send back the goods or hand them over to theexhibitor immediately and in any case no later than fourteendays from the day on which you inform the exhibitorabout the revocation of this contract.The deadline is met if you send back the goods beforethe period of fourteen days has expired. The exhibitorbears the cost of returning the goods.You only have to pay for any loss in value of the goods ifthis loss in value is due to the handling of the goods thatis not necessary to establish the nature, properties andfunctioning of the goods.80
