420 Rechtsprechung von einer Alkoholkrankheit darauf hindeuten, dass der Kläger bei seiner Trunkenheitsfahrt schuldunfähig mit der Folge war, dass eine Sperrzeit nach § 144 Abs. 1 Nr. 1 SGB III nicht eingetreten ist. Dagegen kann aber die strafrechtliche Würdigung des Vorgangs sprechen, die anscheinend nicht von einer Rauschtat (§ 323a Strafgesetzbuch) ausgegangen ist. Ergibt sich, dass eine fristlose Kündigung nicht, eine fristgebundene verhaltensbedingte ordentliche Kündigung aber gerechtfertigt ist, ist die Sperrzeit jedenfalls nicht am 11. Januar 2000, sondern erst mit Ablauf der für den Arbeitgeber maßgebenden Kündigungsfrist eingetreten (BSGE 67, 26, 28 = SozR 3-4100 § 119 Nr. 3). Ein früherer Eintritt der Arbeitslosigkeit wäre nicht durch das Verhalten des Klägers verursacht. Leistungsrechtlich wäre die „festgestellte“ Sperrzeit unmittelbar nur erheblich, soweit sie den Zeitraum nach Ablauf der Kündigungsfrist betrifft. Unabhängig hiervon ist die Anspruchsminderung nach § 128 Abs. 1 Nr. 4 SGB III. Diese Vorschrift knüpft BLUTALKOHOL VOL. 42/2005 ausschließlich an den Eintritt einer Sperrzeit von 12 Wochen nach § 144 Abs. 1 Nr. 1 SGB III an. Diese tritt kraft Gesetzes ein und bedarf deshalb eines entsprechenden Ausspruchs durch Verwaltungsakt nicht (BSG SozR 3-4100 § 119 Nr. 18; BSGE 83, 95, 98 = SozR 3-4100 § 120 Nr. 2; BSGE 89, 243, 249 = SozR 3-4300 § 144 Nr. 8 m. zust. Anm. Wank, SGb 2003, 112). 3. Ob der Kläger einen wichtigen Grund für seine Fahrt hatte, weil seine Schwester dringend um einen Besuch gebeten hatte, muss mangels entsprechender Feststellungen des LSG tatrichterlicher Prüfung vorbehalten bleiben. Die Frage, ob eine besondere Härte i. S. des § 144 Abs. 3 SGB III anzunehmen ist, wird in Rechtsprechung und Schrifttum unterschiedlich beurteilt (verneinend: LSG Rheinland-Pfalz, NZS 2003, 105, 106; bejahend: Niesel, SGB III, 2. Aufl. 2002, § 144 RdNr. 49). Gerade diese Beurteilung ist von den zum Eintritt einer Sperrzeit führenden Umständen im Einzelfall abhängig.

PEI is the only therapy left for patients with a uni- or multilocular hepatocellular carcinoma in a progressive state with or without liver cirrhosis, when surgical resection or chemoembolization is no longer possible. During treatment as well as afterwards major deficits and symptoms or severe drunkenness can be observed in relation to the injected amount of alcohol. Therefore continuous monitoring of alcohol concentration is urgently needed to supervise the patient and improve the therapy. Since all hitherto known devices were normally used with breathing patients and patients who are awake, methods had to be developed to allow these measurings to be taken with patients breathing not spontaneous, and are connected to a ventilator under general anesthesia. In contrast to measuring alcohol levels in conscious patients the tested devices were inserted into intubated patients as part of the main or secondary flow procedure. Since one device used in this study (Alcomed 3011 by Envitec Wismar) sucks in air from the ventilator through a test tube everytime measuring was triggered manually, the point of time for taking the measuring had to be chosen such that sample taking of breath took place during expiration. When choosing the right point of time it is absolutely necessary to use only alveolar breath for measuring. In the following we want to find out if the measuring of alcohol levels in breath of intubated patients is feasible and produces acceptable results.
