Hinsichtlich der Frage, worüber letztlich berichtet werden wird, sind die in 2005 für das Jahr<br />
2004 erscheinenden Berichte abzuwarten.<br />
7.13 KING Code of Corporate Practices and Conduct in Südafrika<br />
Unternehmen, die in der Johannesburg Securities Exchange (JSE) gelistet sind, müssen ab<br />
September 2003 den “Code of Corporate Practices and Conduct“ (King Code) befolgen<br />
(Baue und Sinclair 2003). Der Code wurde 2002 <strong>durch</strong> das King Committee on Corporate<br />
Governance entwickelt (<strong>Institute</strong> of Directors 2005). Er behandelt Kernthemen der Corporate<br />
Governance, schreibt die Berichterstattung zur Nachhaltigkeit bindend vor und verlangt die<br />
Anwendung der Leitlinien der Global Reporting Initiative (GRI) in der ökologischen und<br />
sozialen Berichterstattung. Im Detail heißt es:<br />
„5.1.1. Every company should report at least annually on the nature and extent of its social, trans<strong>for</strong>mation,<br />
ethical, safety, health and environmental management policies and practices. The board must<br />
determine what is relevant <strong>for</strong> disclosure, having regard to the company’s particular circumstances.<br />
5.1.2. Stakeholder reporting requires an integrated approach. This would be best achieved gradually<br />
as the board and the company develop an understanding of the intricate relationships and issues associated<br />
with stakeholder reporting. ……<br />
Disclosure of non-financial in<strong>for</strong>mation should be governed by the principles of reliability, relevance,<br />
clarity, comparability, timeliness and verifiability with reference to the Global Reporting Initiative <strong>Sustainability</strong><br />
Reporting Guidelines on economic, environmental and social per<strong>for</strong>mance.”<br />
Der Rahmen der <strong>durch</strong> KING II angestrebten Berichterstattung fokussiert auf spezifisch<br />
südafrikanische Themen. Eine südafrikanische Anwaltskanzlei empfiehlt:<br />
A South African board should disclose<br />
• the HIV/AIDS strategy plan and policies the company has in place to address and manage the potential impact<br />
of HIV/AIDS on the company;<br />
• the company's <strong>for</strong>mal procurement policies that take into account black economic empowerment;<br />
• whether it has developed and implemented a definitive set of standards and practices in the company based<br />
on a clearly articulated code of ethics.<br />
Principles of reliability, relevance, clarity, comparability, timeliness and verifiability should govern a company's<br />

Es wird deutlich, dass die Schwerpunkte des Reportings hier deutlich von den in<br />
Deutschland üblichen abweichen werden. Dies bestätigt sich auch in den Interviews. „KING<br />
II includes Black Economic Empowerment (BEE), which is unique to South Africa. Some<br />
companies are focussing on BEE and not on sustainability issues. So the focus will be 80 to<br />
90% on BEE and only 10% on sustainability. And big financial companies do not think that<br />
they have a big impact on the environment, so they would focus on BEE and the social responsibility”<br />
beschreibt ein Testierer die Themenwahl.<br />
Wesentlich unterstützende Wirkung geht davon aus, dass die Johannesburg Security<br />
Exchange (JSE) einen eigenen <strong>Sustainability</strong> Index aufgestellt hat. Hierfür wurden alle bei<br />
der JSE gelisteten Firmen Fragebögen verschickt, die zu umfangreichen Reviews der<br />
sozialen und umweltbezogenen Aktivitäten führten. Auch stieg in der Wahrnehmung eines<br />
Testierers die Anzahl der Berichterstatter, wenn auch auf niedrigem Niveau: „More companies<br />
are wanting to get out a sustainability report because they want to comply with KING II,<br />
but they are not understanding the reasoning about sustainability reports.” Auch wird von<br />
dem Testierer eine Zunahme der Nachfrage nach <strong>Testate</strong>n festgestellt.<br />
Ein testiertes Unternehmen sieht, wie schon von Befragten in Großbritannien festgestellt,<br />
Finanzfachleute sich verstärkt mit Nachhaltigkeit beschäftigen: „KING II also has encouraged<br />
