In the case of production of pesticides, which are pesistent or accumulating<br />

or restricted according to the directive on Bans on the Placing on the Market<br />

and the Use of Plant Protecting Agents Containing Particular Active Substances<br />

Regulations on Water Quality<br />

The legal framework for water management is the Federal Water Act [Wasserhaushaltsgesetz -<br />

WHG]. The WHG applies to waste water generated by various industrial processes. The usage<br />

of surface, coastal, and gro<strong>und</strong> waters requires the approval of the competent authority. Discharges<br />

into water are regulated in the Waste Water Ordinance including its Annexes [<strong>Abwasser</strong>verordnung,<br />

AbwV]. It specifies the minimum requirements to be stipulated when granting<br />

a permit to discharge waste water from the source categories listed in the Appendices into<br />

receiving water.<br />

Issued by the Federal Government in consent with the Federal States (Länder), these minimum<br />

requirements bind the authority competent for licensing and controlling the discharges. Depending<br />

on the local conditions, more stringent requirements can be established. The minimum<br />

requirements are based on the ‘emission principle’ and the precautionary principle. General<br />

requirements according to the Waste Water Ordinance are covered by the Article 3 listed below:<br />

General requirements<br />

i. unless otherwise stated in the Appendices, a permit to discharge waste water into waterbodies<br />

shall only be granted if the pollutant load at the site of occurrence, based on an examination<br />

of the conditions in each individual case, is kept as low as the use of watersaving<br />

procedures such as washing and cleaning operations, indirect cooling and the use<br />

of low-pollutant feedstocks and auxiliary materials permit<br />

ii. the requirements of this Ordinance must not be met by means of procedures whereby<br />

environmental pollution is transferred to other environmental media such as air or soil,<br />

contrary to state-of-art<br />

iii. requirements specified in the form of concentration levels must not be achieved via dilution,<br />

contrary to state-of-art<br />

iv. if requirements prior to blending are specified, then blending shall be permissible for the<br />

purpose of joint treatment, provided at least the same overall reduction of contaminant<br />

load per parameter is achieved as would be the case via separate compliance with the<br />

relevant requirement<br />

v. if requirements are specified for the site of occurrence of waste water, blending is only<br />

permissible provided these requirements are adhered to<br />

vi. if waste water flows which are subject to differing requirements are discharged jointly,<br />

then the relevant decisive requirement for each parameter shall be determined by means<br />

of alligation<br />
