a) provide sufficient strength of gro<strong>und</strong> and be impervious;<br />

b) be equipped with the necessary gradients and possibly also with upright edges, to ensure<br />

that all spilt liquids drain to a collection system; the elimination of collected liquids is effected<br />

in accordance with regulatory provisions, in particular those relating to the disposal<br />

of waste materials;<br />

for P1 and/or P2 products this filling position and these zones must always be located in the<br />

open air or <strong>und</strong>er a shelter;<br />

no trenches, crawl spaces or rooms may be present <strong>und</strong>er the aforementioned filling position<br />

and zones; in the case of weighbridges, effective arrangements must be made to limit the<br />

spreading of leaks and to preclude any danger of explosion;<br />

the provisions of this paragraph are not applicable to storage sites for products only intended<br />

for the heating of buildings.<br />

7. during filling with P1 or P2 products, measures must be taken to divert static electricity; the<br />

electrical connection between the road tanker and the container must be made before the filling<br />

operation is commenced and may only be broken after the filling hose has been uncoupled<br />

when the filling is completed;<br />

8. adequate measures must be taken to maintain the storage at atmospheric pressure;<br />

the <strong>und</strong>ergro<strong>und</strong> ventilation and vapour recovery piping must fulfil the same requirements as<br />

the rest of the piping; in addition, the abovegro<strong>und</strong> ventilation piping must have sufficient<br />

mechanical strength<br />

9. it is forbidden to fill a container with another liquid than the one for which the container has<br />

been designed, unless after an inspection by an environmental expert accredited in the discipline<br />

containers for gases or hazardous substances or by an authorised expert, proving that<br />

the container in question is suitable for such other liquid.<br />

Art. 5.17.1.18<br />

The overfilling protection described in appendix 5.17.7 must be manufactured in accordance<br />

with a code of good practice accepted by an environmental expert accredited in the discipline<br />

containers for gases or hazardous substances.<br />

The control of the construction must be performed in accordance with the selected code of good<br />

practice by an environmental expert accredited in the discipline containers for gases or hazardous<br />

substances.<br />

The control of the construction for overfilling protection devices manufactured in series may be<br />

limited to a single approval of the prototype. The approval of the prototype must be performed<br />

by one of the aforementioned environmental experts and in accordance with the procedure of<br />

appendix 5.17.7.<br />

The report on the approval mentions the controls carried out and must be signed by the aforementioned<br />

expert.<br />

For each overfilling protection device the operator must dispose of a certificate signed by the<br />

constructor. This certificate must mention the number of the prototype approval certificate and<br />

the name of the environmental expert who issued the test certificate (and his accreditation number).<br />

The constructor also confirms in the certificate that the overfilling protection has been<br />

built and controlled in accordance with the provisions of title II of VLAREM.<br />

Art. 5.17.1.19<br />

§ 1. Organic peroxides which may explode or detonate in a violent thermal reaction must be<br />

retained at the establishment at a temperature lower than the temperature which from the point<br />

of view of safety is the permissible maximum temperature according to the nature of the substance<br />

concerned. For the substances indicated below, this maximum temperature is:<br />
