Art. 5.17.1.8<br />

§ 1. Without prejudice to any other relevant legal or regulatory provisions, the operator takes all<br />

measures required to sufficiently protect the surro<strong>und</strong>ing area against the risks of fire and explosion.<br />

One of the implications of this is that the necessary firefighting equipment must be provided.<br />

The type of firefighting equipment required and where it should be kept is determined after<br />

consultation with the authorised fire brigade. This matter is completely unrelated to the environmental<br />

licence.<br />

The firefighting equipment must be kept in a properly maintained condition, protected against<br />

frost, appropriately marked, easily accessible and placed in appropriate locations. The firefighting<br />

equipment must be able to be deployed immediately.<br />

§ 2. At the establishment, in consultation with the authorised fire brigade the necessary provisions<br />

must be present to prevent fire extinguishing water contaminated with dangerous products<br />

from draining into the gro<strong>und</strong>, public sewers, surface or gro<strong>und</strong>water. The collected contaminated<br />

fire extinguishing water must be disposed of in an appropriate fashion. The collection<br />

capacity for contaminated fire extinguishing water must be determined in consultation with the<br />

authorised fire brigade.<br />

Art. 5.17.1.9<br />

§ 1. The electrical installations, appliances and lighting appliances must meet the requirements<br />

of the General Regulations for Labour Safety or of the general regulations for electrical installations,<br />

in particular the articles dealing with spaces in which an explosive atmosphere can<br />

originate.<br />

§ 2. Without prejudice to the regulatory provisions, in zones where there is danger of fire and<br />

explosion because of the possible accidental presence of an explosive mixture, electrical installations<br />

must be designed and installed according to the conditions of a zoning plan.<br />

§ 3. With respect to installations for which the general regulations for electrical installations are<br />

not as yet applicable, the zoning is to take place in accordance with the provisions of article 105<br />

of the said general regulations.<br />

Art. 5.17.1.10<br />

§ 1. Containers intended for the storage of extremely toxic, toxic, harmful or corrosive liquids<br />

with a vapour pressure of over 13.3 kPa at a temperature of 35 °C, must be equipped with an<br />

effective system to restrict to a minimum the air pollution during storage and handling, such as<br />

a vapour recovery system, a floating roof, or another equivalent system.<br />

§ 2. With the loading and unloading of storage containers and/or supplying road tankers, rail<br />

tankers or tanker vessels containing the liquids referred to in § 1, air pollution must be restricted<br />

to a minimum.<br />

Art. 5.17.1.11<br />

§ 1. Without prejudice to the obligations from article 7 of title I of VLAREM, the operator of a<br />

category 1 establishment must keep a register or alternative data carrier in which, per main<br />

property, at least the nature and quantities of the stored hazardous products are specified.<br />

This information must be stored in such a way that it is possible at all times to determine the<br />

quantities of hazardous products present at the establishment.<br />
