Allgemeine Vertragsbedingungen<br />
General Conditions of Contract<br />
Deutsch<br />
<strong>Haslital</strong> Tourismus vermittelt touristische Unterkünfte und Leistungen <strong>im</strong> Auftrag<br />
deren gegenwärtiger Besitzer bzw. deren Vertreter und ist berechtigt das<br />
Inkasso namens der <strong>Hotels</strong> und Vermieter vorzunehmen. Der Vertragspartner<br />
des Gastes ist der Bestätigung/Rechnung ersichtlich.<br />
Vertragsabschluss<br />
Der Vertrag kommt mit der vorbehaltlosen Annahme Ihrer Buchung zu Stande.<br />
<strong>Haslital</strong> Tourismus bestätigt schriftlich die Buchung <strong>im</strong> Auftrage und namens<br />
des jeweiligen <strong>Hotels</strong> resp. Ferienwohnungsvermieters.<br />
Die Reservationsbestätigung/Rechnung gilt als Mietvertrag.<br />
Zahlungsbedingungen<br />
Eine Anzahlung ist innert 15 Tagen nach Buchung/Erhalt der Bestätigung/<br />
Rechnung zu bezahlen.<br />
Hotelunterkunft Anzahlung: Preis für 3 Übernachtungen zuzüglich Annullierungs-kostenschutz.<br />
Ferienwohnung/Ferienhaus Anzahlung: 40% der Wohnungs-miete zuzüglich<br />
Annullierungskostenschutz.<br />
Die Restzahlung hat bis 30 Tage vor Ankunft zu erfolgen.<br />
Bei Buchungen innert weniger als 41 Tagen vor der Ankunft ist der gesamte<br />
Betrag inkl. Annullierungskostenschutz innert 10 Tagen nach Buchung/Erhalt<br />
der Bestätigung/Rechnung zu zahlen. Bei diesen kurzfristigen Buchungen empfehlen<br />
wir die Bezahlung mit Kreditkarte.<br />
Die Anzahlung kann auch mittels REKA-Checks/REKA-Card bezahlt werden.<br />
Die Bankverbindung lautet:<br />

Bei Buchungen über Internet und bei Buchungen mit Kreditkartenzahlung entfällt<br />
die An- sowie die Restzahlung. Der Reservations-Totalbetrag wird der Kreditkarte<br />
belastet, sobald die entsprechenden Kreditkartenangaben eingetragen<br />
sind und die Reservation abgeschlossen ist.<br />
Preise; Preis- und Leistungsänderungen<br />
Preis- und Leistungsänderungen vor der Buchung bleiben ausdrücklich vorbehalten.<br />
Sollten solche Änderungen eintreten werden Sie anlässlich der Buchung<br />
darüber informiert. Massgebend sind die Preise in Schweizer Franken. Ausländische<br />
Währungen werden nur zur Information aufgeführt. Die in der Bestätigung/Rechnung<br />
aufgeführten Preise sind verbindlich. Eine Preisanpassung für<br />
Gründe die wir nicht beeinflussen können (z.B. Währungsschwankungen, neu<br />
eingeführte oder erhöhte Taxen), behalten wir uns vor.<br />
Der Vermieter/Hotelier behält sich das Recht vor, dem Gast eine gleichwertige<br />
Ersatzunterkunft zuzuweisen, wenn nicht vorhersehbare oder nicht abwendbare<br />
Umstände dies erfordern.<br />
Buchungsänderungen und Annullierungskosten; Versicherungen<br />
Für Buchungsänderungen (Aufenthaltsdaten, Personenzahl, Z<strong>im</strong>merzahl, Objektart)<br />
wird eine Bearbeitungsgebühr von CHF 50.00 erhoben. Kann die Änderung<br />
nicht vorgenommen werden und wird der Vertrag annulliert, gelten die untenstehenden<br />
Bedingungen.<br />
Wird der Vertrag annulliert/storniert, so werden folgende Annullierungskosten<br />
fällig:<br />
bis 30 Tage vor Ankunft 100 % der Anzahlung<br />
ab 29 Tage vor Ankunft der gesamte vereinbarte Betrag (ohne Nebenkosten)<br />
Massgebend ist das Eintreffen Ihrer Mitteilung bei der Buchungsstelle (bei<br />
Samstagen, Sonntagen und allgemeinen Feiertagen gilt der nächste Arbeitstag).<br />
Kann die Unterkunft nach einer Annullation weitervermietet werden, ist der Vermieter/Hotelier<br />
verpflichtet, dem Gast/Mieter den bezahlten Betrag abzüglich<br />
einer Annullationsgebühr von CHF 100.00 zurückzuerstatten.<br />
Hausordnung, Anzahl Personen<br />
Die in der Ausschreibung und <strong>im</strong> Vertrag aufgeführte Personenzahl darf nicht<br />
überschritten werden. Die Hausordnung des gebuchten Objektes ist Bestandteil<br />
dieses Vertrages. Wird die Personenzahl überschritten oder die Hausordnung<br />
nicht beachtet, so kann nach einer erfolglosen Ermahnung der Vertrag fristlos<br />
aufgelöst werden. In diesem Fall bleibt der vereinbarte Preis geschuldet.<br />
Der Mieter/Vertragspartner haftet für eine sorgfältige Benützung des Objektes,<br />
auch allfälliger Mitbenützer und Gäste. Schäden sind unverzüglich, spätestens<br />
bei Mietende zu melden. Der Vermieter/Hotelier behält sich das Recht vor, allfällige<br />
Schäden noch nach Vertragsbeendung geltend zu machen.<br />
Beanstandungen<br />
Sollte das Objekt bei Bezug Mängel aufweisen, solche während der Vertragszeit<br />
auftreten oder der Mieter usw. Schaden erleiden, so ist dies sofort dem<br />
Vermieter/Hotelier mitzuteilen (Adresse usw. auf der Bestätigung/Rechnung).<br />

Dieser ist bemüht, Abhilfe zu schaffen. Sollte die Abhilfe ungenügend sein, so<br />
lassen Sie sich dies schriftlich bestätigen. Minderungs-, Schadenersatzansprüche<br />
usw. sind innert 30 Tagen nach vertraglichem Vertragsende schriftlich be<strong>im</strong><br />
Vermieter/Hotelier geltend zu machen. Werden Mängel oder Schäden nicht<br />
unverzüglich nach deren Eintritt dem Vermieter/Hotelier mitgeteilt oder die Frist<br />
von 30 Tagen nicht eingehalten, so verwirken sämtliche Rechte.<br />
Verspätete Anreise, vorzeitige Abreise, verkürzte Aufenthalte<br />
Bei verspäteter Anreise, wie vorzeitiger Abreise bleibt der gesamte vereinbarte<br />
Preis geschuldet. Verspätete Anreise infolge Verkehrs- und Witterungslage,<br />
verzögerter Grenzabfertigung, Streiks, höhere Gewalt usw. liegen <strong>im</strong> Risikobereich<br />
des Gastes und geben kein Anrecht auf Preisminderung.<br />
Haftung des Vermieters/Hoteliers<br />
Der Vermieter/Hotelier haftet für die gehörige Erfüllung des Vertrages, wobei<br />
die Haftung für leichtes Verschulden ausgeschlossen ist. Davon ausgenommen<br />
sind zwingende gesetzliche Haftungsbest<strong>im</strong>mungen.<br />
Der Vermieter/Hotelier haftet insbesondere nicht bei höherer Gewalt, Naturereignissen,<br />
Umweltschäden, Umwelteinflüssen, Schäden durch Dritte sowie<br />
für Ereignisse, welche trotz gebotener Sorgfalt nicht voraussehbar oder abwendbar<br />
sind. Gleichfalls besteht keine Haftung für die Infrastrukturbetriebe<br />
(z.B. Elektrizität, Wasser usw.) und touristische Unternehmen (Schw<strong>im</strong>mbad,<br />
Bahnen usw.), auch wenn dadurch das gebuchte Objekt betroffen wird. Die<br />
ausservertragliche Haftung richtet sich nach den gesetzlichen Best<strong>im</strong>mungen,<br />
wobei weitergehende Haftungsbeschränkungen und Haftungsausschlüsse dieser<br />
Bedingungen den gesetzlichen Best<strong>im</strong>mungen vorgehen. Vertragliche wie<br />
ausservertragliche Ansprüche verjähren innert einem Jahr nach vertraglichem<br />
Vertragsende, ausser es gelten kürzere gesetzliche Fristen.<br />
Haftung <strong>Haslital</strong> Tourismus<br />
<strong>Haslital</strong> Tourismus steht für eine korrekte Buchung ein und haftet als Vermittler<br />
für die vermittelten Dienstleistungen nicht. Die Haftung für leichtes Verschulden<br />
wird wegbedungen. Die ausservertragliche Haftung richtet sich nach den<br />
gesetzlichen Best<strong>im</strong>mungen, wobei die Haftung für leichtes Verschulden wegbedungen<br />
wird.<br />
Anwendbares Recht und Gerichtsstand (gemeinsame Best<strong>im</strong>mungen)<br />
Auf die Verhältnisse zwischen Gast und Vermieter/Hotelier und das Verhältnis<br />
Gast – <strong>Haslital</strong> Tourismus findet ausschließlich schweizerisches Recht anwendbar.<br />
– Die Parteien vereinbaren den ausschliesslichen Gerichtsstand Interlaken,<br />
CH 3800 Interlaken, Schweiz.<br />

English<br />
<strong>Haslital</strong> Tourismus acts as an agent to rent tourist accommodation and services on<br />
behalf of the owner or their proxy and is authorised to receive payment on behalf of<br />
said owner/proxy. The contract partners are visible on the confirmation and invoice.<br />
Contract Conclusion<br />
The contract becomes final with the unconditional acceptance of the booking. <strong>Haslital</strong><br />
Tourismus will confirm the booking in writing on behalf of the respective hotel/holiday<br />
apartment leasor. The confirmation/invoice is deemed to be the rental contract.<br />
Conditions of Payment<br />
A downpayment is to be paid within 15 days of receipt of the confirmation/invoice.<br />
Hotel downpayment: Price for 3 nights accommodation plus cancellation insurance.<br />
Holiday apartment/chalet downpayment: 40% of the rent plus cancellation insurance.<br />
The balance must be paid at least 30 days before arrival. Bookings made less then<br />
41 days before arrival date must be paid in total within 10 days of receiving the<br />
confirmation/ invoice -including cancellation insurance. Such short notice bookings<br />
are recommended to be paid by credit card. Downpayment can be made using REKA-<br />
Checks/REKA-Card.<br />

Bookings made over the internet and those paid by credit card will be charged in one<br />
lump sum as soon as the relevant credit card number is received.<br />
Prices; Changes to prices and services<br />
We reserve the right to change prices and services at any t<strong>im</strong>e. Should any changes<br />
occur, you will be advised at the t<strong>im</strong>e of booking. The prices are stated in Swiss Francs<br />
– the other currencies are only an indication of the price at the t<strong>im</strong>e of printing. The<br />
prices in the reservation/invoice are binding. We reserve the right to change prices<br />
due to factors beyond our control (e.g. change of exchange rates, newly introduced<br />
or increased taxes).<br />
The leasor/hotel proprietor reserves the right to offer the leasee an equivalent accommodation,<br />
should it be necessary.<br />
Changes to Bookings and Cancellation Costs; Insurances<br />
Changes to the booking (new dates, amounts of people, numbers of rooms, type of<br />
accommodation) will incur a charge of CHF 50.00. Should the changes not be possible,<br />
the booking will be cancelled.<br />
If the contract is cancelled the following cancellation charges will be incurred:<br />
Up to 30 days before arrival date: 100 % of the deposit<br />
Less than 30 days before arrival: The entire accommodation cost (no additional<br />
charges).<br />
Decisive is the date your notification is received in the booking office (e.g. Saturdays,<br />
Sundays and public holidays will be the next official working day).<br />
Should the accommodation be rented out again after cancellation, the leasor/proprietor<br />
is bound to re<strong>im</strong>burse the leasee (who had to cancel) the sum paid, less a cancellation<br />
charge of CHF 100.00.<br />
House Rules, Number of Persons<br />
The number of persons advised in our publications and in the contract must not be<br />
exceeded. The house rules of the object booked is a statutory part of this contract.<br />
Should the number of occupants be exceeded or the house rules not adhered to, and<br />
after one warning, the contract may be cancelled <strong>im</strong>mediately. In this case the contractural<br />
price paid is still due.<br />
The leasee/contractural partner asumes responsibility for the careful use of the accommodation,<br />
that includes all people staying in the accommodation. Any damage<br />
should be reported <strong>im</strong>mediately. The leasor/proprietor retains the right to charge for<br />
any damage caused – even after the contract has expired.<br />
Complaints<br />
Should the accommodation have any defects, should any defects occur during occupation<br />
or the leasee suffer any damage, these should be reported to the leasor <strong>im</strong>mediately<br />
(address is on the confirmation/invoice). The leasor will attempt to remedy the<br />
situation. Should the problem not be solved satisfactorily, please put your cla<strong>im</strong>s in<br />
writing. Cla<strong>im</strong>s for damage or a lessening of the rental fee must be received by the<br />
leasor/proprietor within 30 days of the contracts end. Should the defects or damages<br />
not be advised to the leasor <strong>im</strong>mediatetly, or the cla<strong>im</strong> not be received within 30 days,<br />
then all rights are forfeit.<br />
Late arrival, early departure, shortened length of stay<br />
Late arrival or early departure have no influence on the rental price and the entire contractural<br />
amount must be paid. Late arrival due to weather or traffic/travel problems,<br />
delays at the border, strikes or „acts of God“ are risks the leasee is responsible for and<br />
as such cannot be cla<strong>im</strong>ed for a price reduction.<br />
Leasor/Proprietors Responsibility<br />
The leasor/proprietor is responsible for the fulfillment of the contract. Liability for minor<br />
fault will not be accepted with the exception of compulsory liability laws. The leasor/<br />
proprietor is not liable for acts of God, natural phenomenons, environmental damage<br />
or influences, vicarious liability or for events which, despite the necessary diligence,<br />
cannot be forseen or averted. No liability will be taken for the building‘s infrastructure,<br />
e.g. electricity, water etc., and touristic establishments, e.g. sw<strong>im</strong>ming pools, transport<br />
lifts, etc. – even when the accommodation booked is affected. The non-contractural<br />
liability is subject to Swiss law. Contractural and non-contractural cla<strong>im</strong>s become t<strong>im</strong>ebarred<br />
one year after the end of contract, except if shorter contractural t<strong>im</strong>es are valid.<br />
Liability of <strong>Haslital</strong> Tourismus<br />
<strong>Haslital</strong> Tourismus strives to ensure the bookings taken are correct and denies any<br />
responsibility for the accommodation. Liability for minor fault is explicitely excluded.<br />
Non-contractural liability is subject to Swiss law.<br />
Applicable Law and Jurisdiction (general conditions)<br />
The relationship between guest and leasor/proprietor comes under Swiss law. The<br />
legal jurisdiction is solely through the Courts of Law in Interlaken, CH 3800 Interlaken,<br />
Schweiz.<br />
