definiert denn «fishing expeditions» ebenfalls <strong>als</strong> Ersuchen, die nicht auf konkreten<br />
und zurechenbaren Tatverdachtselementen beruhen. 95)<br />
Mit Blick auf die aktuelle Rechtsprechung des Bundesgerichts gelten im<br />
Bereich der Rechtshilfe in Steuerstrafsachen traditionell sogar besonders hohe<br />
Anforderungen an die präzise Begründung eines Sachverhalts, um unzulässige<br />
Fiskalausforschungen zu verhindern. 96)<br />
V. «Gruppenanfragen» vs. «fishing expeditions»<br />
Als konkrete und aktuelle Beispiele, bei welchen im Rahmen der Kooperation<br />
von Verwaltungsbehörden die Minimalgarantien der EMRK unterlaufen werden,<br />
folgt eine Darstellung der strafprozessual unzulässigen «fishing expeditions»,<br />
welche die ESTV aufgrund der «Gruppenanfragen» des IRS betreffend die UBS<br />
AG und die Credit Suisse AG durchführte bzw. momentan durchführt.<br />
V.1. Das UBS- und das CS-Ersuchen <strong>als</strong> «Gruppenanfragen»<br />
V.1.1. UBS-Ersuchen<br />
Beim UBS-Ersuchen vom 31. August 2009 wurden im Ersuchen keine Personen<br />
namentlich oder sonstwie identifiziert:<br />
«The US Competent Authority seeks information regarding US taxpayers who at any time<br />
during the years ended December 31, 2001 through December 31, 2008 had signature<br />
or other authority (including authority to withdraw funds; to make investment decisions;<br />
to receive account statements, trade confirmations, or other account information; or to<br />
receive advice or solicitations) with respect to any financial accounts maintained at, monitored<br />
by, or managed through any office of UBS AG Switzerland (‹UBS›) or its subsidiaries<br />
or affiliates in Switzerland and for whom UBS or its subsidiaries or affiliates (1) did<br />
not have in its possession Forms W-9 executed by such US taxpayers; and (2) had not filed<br />
timely and accurate Forms 1099 naming such US taxpayers and reporting to US taxing<br />
authorities, specifically the Internal Revenue Service (‹IRS›), all payments made to such<br />
US taxpayers. For purposes of this request, this specified group of US taxpayers with undeclared<br />
UBS accounts is hereinafter referred to as ‹UBS United States clients›.» 97)<br />
