wie<strong>de</strong>rholen<strong>de</strong>n Weise –, dass sich die Entscheidung, ob die »interests of<br />
justice« einen unentgeltlichen Verteidiger erfor<strong>de</strong>rn, danach bestimmt, ob es<br />
<strong>de</strong>m Angeklagten im gesamten Verfahren auch ohne einen Verteidigerbeistand<br />
möglich ist, sich selbst in einer konkreten und effektiven Weise zu<br />
verteidigen. 21 Deutlich heißt es insofern etwa in <strong>de</strong>r Entscheidung R.D. v.<br />
PL:<br />
»… There is, however, a primary, indispensable requirement of the<br />
›interests of justice‹ that must be satisfied in each case. That is the<br />
requirement of a fair procedure before courts, which, among other<br />
things, imposes on the State authorities an obligation to offer an accused<br />
a realistic chance to <strong>de</strong>fend himself throughout the entire trial.<br />
In the context of cassation proceedings, that means that the authorities<br />
must give an accused the opportunity of putting his case in the<br />
cassation court in a concrete and effective way …«. 22<br />
