Finanzen verstärkt miteinander zu verknüpfen. Damit ist der<br />
Prüfer in der Lage, einen Vorgang von der zollrechtlichen Wiege<br />
bis zur kaufmännischen Bahre lückenlos nachzuvollziehen.<br />
Zudem sollte eine gemeinsame Datenbasis vorhanden sein, um<br />
zentral wichtige Risikoparameter und die Veränderungen zu<br />
dokumentieren. Dabei sollte beispielsweise ersichtlich sein:<br />
• Wurde eine Ware falsch tarifiert?<br />
• Kam es im Zuge der Abgabenerhebung es zu Abrechnungs -<br />
fehlern oder nicht?<br />
• Welche Schulungsmaßnahmen im Bereich Außenwirtschaft<br />
wurden umgesetzt?<br />
• Haben die gegenüber dem Zoll dargelegten Prozesse im<br />
Rahmen der AEO-Beantragung noch Gültigkeit (Monitoring)?<br />
Diese und weitere Parameter sollen dem Wirtschaftbeteiligten<br />
und den Zollbehörden ein umfass<strong>end</strong>es Bild über das Risikoprofil<br />
des Unternehmens ermöglichen. Dass es dazu entsprech<strong>end</strong><br />
leistungsfähiger, stark vernetzter Systeme bedarf, ist offensichtlich.<br />
Ausblick<br />
Dieser Beitrag sowie die vorangegangenen Teile der Serie haben<br />
deutlich gezeigt: Der Status des AEO ist überaus attraktiv. Zwar<br />
ist er mit großen Anforderungen verknüpft und sie nachzuweisen<br />
erfordert einen beträchtlichen Aufwand. Seine Vorteile aber lohnen<br />
das allemal. Der AEO wird, so zeichnet es sich heute schon<br />
ab, zu einem international anerkannten Standard. Wer ihn erreicht,<br />
weist sich als zuverlässiger Teilnehmer des Wirtschaftskreislaufs<br />
aus, dem andere getrost vertrauen dürfen. Dass dies<br />
ein Wettbewerbsvorteil ist, liegt auf der Hand. Mehr noch: Vermutlich<br />
werden sich Unternehmen, die den AOE selbst nicht vor-<br />

Authorized Economic Operator – Part 6: The AEO and risk management<br />
The Framework of Standards to Secure and Facilitate Global Trade (SAFE) sets the general conditions to secure global trade on a<br />
uniform and internationally accepted basis. It should help customs to establish and maintain an effective risk management system<br />
with the prime objective to secure transactions worldwide. This should be done not only with regard to terrorist attacks but also by<br />
involving health protection or restrain contraband or any kind of counterfeiting.<br />
A pillar of such measures would be a screening of transactions by using competent information technology: In order to evaluate<br />
potential risks it is necessary to make the transaction transparent for a critical review. An IT-based handling is therefore essential.<br />
Presently, nearly all transactions relevant for customs need to be reported electronically. Since April 1, <strong>2010</strong> Excise Movement and<br />
Control System (EMCS) will replace the presently used reporting systems. The AEO must evaluate possible risks based on the<br />
IT-systems available to him and communicate the results to Customs which finally evaluates the transactions referred to it. In the<br />
future, data will be available already before goods are actually moved.<br />
If possible, the companies should make an adequate risk assessment prior to the transaction and match addresses of their<br />
business partners with the list of potential suspects. In the course of the AEO-certification process evidence must be produced<br />
that an adequate internal organization to that effect exists.<br />
In view of the changes in customs regulations over the past months, the status of an AEO towards the administration has been<br />
enhanced. This is also true in light of the upcoming modernized customs code, which will furthermore emphasize the importance<br />
of the AEO.<br />
As he gradually establishes himself on international grounds, the reputation of the AEO will grow significantly. Customs will prefer<br />
those kinds of transactions or movements of goods which are save and ideally where all parties involved have adequate status.<br />
A common data base should document and connect all relevant risk parameters and changes and an efficient customs-riskmanagement-system<br />
must secure that the operational processing is handled thoroughly and safely.<br />
An AEO employs qualified staff, he sufficiently secures his facilities and the goods stored. He only deals with reliable partners,<br />
uses IT-systems to document flow of goods and business transactions and he secures all important data.<br />

Sie den AEO auch als ein zentrales Element eines umfass<strong>end</strong>en<br />
Risikomanagements. Denn die Anforderungen, welche die Behörden<br />
an einen AEO stellen, umfassen ein hohes Maß an Transparenz<br />
mit Blick auf Risiken beim Warenfluss, was dem eigenen<br />
internen Risikomanagement nur förderlich sein kann. Und noch<br />
etwas: Das Risiko eines Vertrauensschadens lässt sich durch<br />
den AEO ausschließen.<br />
