ANNEX A<br />

COURSE OF SPECIFIED SECTIONS OF THE FRONTIER BETWEEN THE KING-<br />

DOM OF THE NETHERLANDS AND THE FEDERAL REPUBLIC OF GER-<br />

MANY, AND SPECIAL PROVISIONS RELATING THERETO<br />

GENERAL PART<br />

Section 1<br />

Old and new frontier<br />

1. For the purposes of this annex, the term "old frontier" means the frontier between<br />

the Kingdom of the Netherlands and the German Reich as it existed on 31 December<br />

1937 under the terms of the Boundary and Frontier Treaties and other Agreements<br />

mentioned in article I of this <strong>Treaty</strong>.<br />

2. For the. purposes of this annex, the term "new frontier" means the frontier<br />

between the Kingdom of the Netherlands and the Federal Republic of Germany under the<br />

terms of article 1 of this <strong>Treaty</strong>, where it deviates from the frontier between the Kingdom<br />

of the Netherlands and the German Reich as it existed on 31 December 1937.<br />

Section 2<br />

Right ol passage<br />

1. For the purposes of this annex, the term "right of passage" means the right to use<br />

specified roads which pass through the territory of the other Contracting Party near the<br />

frontier. No frontier clearance shall be effected. No import or export duties or other<br />

import or export charges shall be collected, and no import, export and transit prohibitions<br />

and restrictions shall apply, with respect to objects taken with them by persons exercising<br />

the right of passage, provided that such objects are re-exported or re-imported, as the<br />

case may be. The provisions of article 36 of this <strong>Treaty</strong> shall apply mutatis mutandis.<br />

2. The right of passage shall be granted to persons who, in the light of local circumstances,<br />

have a legitimate interest in the use of such roads, by means of a certificate<br />

issued by the competent authority of the Contracting Party in whose territory the person<br />

resi<strong>des</strong>. No frontier crossing paper other than the certificate need be carried.<br />

3. The Contracting Parties shall agree on the form of the certificate by an exchange<br />

of notes and shall notify each other of the authorities competent to issue the certificates.<br />

Such authorities shall communicate to the frontier control authorities of the other Contracting<br />

Party the names of the persons to whom certificates have been issued or from<br />

whom certificates have been withdrawn.<br />

4. Frontier control and Customs officers shall be entitled, when exercising the<br />

right of passage, to wear their uniform or an official badge visibly and to take with them<br />

their service weapons, vehicles, official equipment and police dogs. They may not,<br />

however, perform any official acts. Such officers shall not require the certificate referred<br />

to in paragraph 2.<br />
