feasible, the gas and water mains shall be laid in the verge of the Schinveld-Koningst<br />

bosch road.<br />

3. The lines may be maintained and repaired by the Netherlands owners.<br />

After completion of the works, the construction areas shall be restored to their original<br />

condition. If any alteration is caused in the Schinveld-Koningsbosch road or in<br />

any road or watercourse which crosses it, the costs of such relocation of the lines as<br />

may thereby be rendered necessary shall be borne by the Netherlands owners.<br />

4. The lines may be used without the consent of the authorities responsible for<br />

supervision under German law only for the purpose of through transmission, but not<br />

for the supply of services within the Federal Republic of Germany.<br />

5. The Netherlands authorities and enterprises shall be entitled to import the<br />

tools and materials required for the installation, maintenance and repair of the lines<br />

mentioned in paragraph I into the Federal Republic of Germany and, if the occasion<br />

arises, to re-export them to the Netherlands free of import and export prohibitions and<br />

restrictions and free of import and export duties and others charges. The transmission<br />

of electricity, gas and water through the lines in question shall not be subject to<br />

the turnover tax or the transport tax or to any similar taxes which may be imposed in<br />

the future.<br />

Article 55<br />

1. This <strong>Treaty</strong> shall be without prejudice to existing rights in the areas referred<br />

to in articles 4 to 6 under mining concessions granted in the past. The Contracting<br />

Parties are prepared, if necessary, to enter into special arrangements permitting the<br />

fields in question to be worked from the territory of the Federal Republic of Germany<br />

or from the territory of the Kingdom of the Netherlands.<br />

2. The Federal Republic of Germany declares its willingness, as soon as a Netherlands<br />

mining company shall have acquired the right to exploit the Hillensberg I, II,<br />

III and Wehr I, II, III coal-fields, to enter into a special arrangement permitting<br />

those coal-fields to be worked from the territory of the Kingdom of the Netherlands,<br />

along similar lines to the arrangements entered into in earlier Agreements between<br />

the Kingdom of the Netherlands and the Federal Republic of Germany concerning<br />

coal-fields situated in the frontier area.<br />

CHAPTER 4<br />

BOUNDARY WATERS<br />

Article 56<br />

1. Boundary waters within the meaning of this chapter are surface waters,<br />

including their banks, which cross or, in some of their sections, form the frontier<br />

between the Netherlands and Germany.<br />
