Article 46<br />

1. Animals infected or suspected of being infected with communicable diseases,<br />

parts of and products derived from such animals and objects of any'kindwhich, in the<br />

light of the circumstances, must be assumed to be carriers of infection may not be<br />

conveyed in transit traffic.<br />

2. Phytosanitary certificates shall not be required for plants and parts thereof<br />

in transit traffic. Phytosanitary frontier clearance shall not be effected except on<br />

grounds of special danger. The competent agencies of the two Contracting Parties<br />

shall notify each other of the existence of such danger.<br />

Article 47<br />

Explosives, weapons of war and ammunition may be conveyed in transit traffic<br />

only 'with the consent of the competent German authorities.<br />

Article 48<br />

1. Until such time as the construction works referred to in article 49, paragraph<br />

1, have been carried out, frontier clearance on the Schinveld-Koningsbosch<br />

road shall be subject to the special provisions set forth below.<br />

2. Occupants of motor vehicles who do not produce a recognized frontier<br />

crossing paper shall be allowed to pass in transit, if the driver of the vehicle identifies<br />

himself by means of an official document bearing a photograph. In such cases, a<br />

pass shall be issued indicating the name and address of the driver, the registration<br />

number of the vehicle, and the number of passengers. Occupants of vehicles bearing<br />

the medallion referred to in paragraph 6 shall be allowed to pass freely in transit.<br />

3. The transit certificate referred to in article 43 shall not be required for vehicles<br />

of the Limburg State Mines (Staatsmijnen in Limburg) and their loads. The<br />

Netherlands Customs administration shall forward a list of such vehicles to the<br />

German Customs administration and shall at all times keep the list up to date.<br />

4. The transit certificate referred to in article 43 shall likewise not be required<br />

for vehicles conveying personnel or loads of the Limburg State Mines or for vehicles<br />

conveying persons or loads on behalf of the State Mines, Limburg. The same shall<br />

apply with respect to the loads referred to in the preceding sentence. 'The Netherlands<br />

Customs administration shall forward a list of such vehicles to the German<br />

Customs administration and shall at all times keep the list up to date. The German<br />

Customs administration may, upon suspicion of any irregularity, demand the removal<br />

of specified vehicles from the list and their consequent forfeiture of this privilege.<br />

5. -Other vehicles which must regularly use the aforementioned road may<br />

likewise be exempted from the requirement of a transit certificate. Such vehicles<br />
