Pflicht zur Verschaffung des Eigentums
an der Kunsthalle:
Der Käufer hat dem Land Berlin durch
entgeltlose Rückübertragung Eigentum an
der Grundstücksfläche, auf der sich die
Kunsthalle befinden wird, zu verschaffen.
Es hängt von dem Ergebnis des nach
Zuschlag durchzuführenden Städtebau-/
Architektenwettbewerbes und der sich da-
nach bestimmenden örtlichen Lage der
Kunsthalle ab, ob dem Land Berlin Allein-
eigentum an einer abtrennbaren Teilfläche
oder Teil- oder Miteigentum zu verschaffen
sein wird. Angestrebt werden soll eine
städtebauliche Lösung, die Alleineigentum
des Landes Berlin ermöglicht.
Konzeptentwicklungspflicht:
Der Käufer hat ein innovatives Inhalts- und
Betriebskonzept für den Kunstort zu ent-
wickeln und mit dem Land Berlin, beraten
durch die Nationalgalerie (Hamburger
Bahnhof – Museum für Gegenwart – Ber-
lin), Einvernehmen über dieses Konzept
herbeizuführen.
Kunstinvestitionspflicht:
Der Käufer hat einen Betrag von min-
destens 50 Mio. € für die Erstausstattung/
„Bespielung“ des Kunstortes sowie weitere
Beträge von jährlich mindestens 3 Mio. €
für die weitere Ausstattung/„Bespielung“
während des Mindestbetriebszeitraumes
von 20 Jahren ab Fertigstellung des Kunst-
ortes zu investieren.
Wenn und soweit der Käufer sich im Rah-
men des Vergabeverfahrens auf konkrete,
von ihm zu beschaffende oder bereit-
zustellende Kunstobjekte beruft, ist er
verpflichtet, diese Kunstobjekte zu be-
schaffen oder bereitzustellen und dem
Kunstort während des Mindestbetriebs-
zeitraumes von 20 Jahren ab Fertigstellung
.
KUNSTORT HUMBOLDTHAFEN
Obligation to procure the art gallery’s
assets:
The buyer must transfer ownership of the
site where the art gallery will be situated
back to the State of Berlin without
compensation. Whether or not the State of
Berlin will have sole ownership of a sepa-
rate part of the site or part/co-ownership
of the entire property will be determined
by the outcome of the competition to find
an urban developer/architect for the site
that is to be held after the contract has
been awarded and by the location of the
art gallery once that has been ultimately
decided on the basis of the competition.
All possible measures will be taken to en-
sure that an urban development solution is
found that guarantees the State of Berlin
sole proprietorship.
Concept development obligation:
The buyer is obliged to develop an inno-
vative content and business concept for
the Art Venue in agreement with the State
of Berlin and in consultancy with the
national gallery (Hamburger Bahnhof –
Museum for Contemporary Art – Berlin).
Obligation to invest in works of art:
The buyer must invest at least €50 million
for the initial furnishing and “equipping” of
the Art Venue and at least a further €3
million each year for at least 20 years after
the completion of the Art Venue for further
furnishing and “equipping”.
The buyer is obliged to procure or supply
any specific artworks it commits itself to
procuring or supplying during the bidding
process; it is also obliged to make these
artworks available to the Art Venue for at
least 20 years after the Art Venue is
