Die Bieter, deren Angebote den formalen
und inhaltlichen Anforderungen entsprechen,
werden im Anschluss an die Angebots-
abgabe zu einem Verhandlungsgespräch
eingeladen. In dem Verhandlungsgespräch
wird mit den Bietern der Inhalt ihrer An-
gebote erörtert und verhandelt.
Der Verkäufer und die ausschreibende
Stelle behalten sich vor, weitere Verhand-
lungsrunden mit den Bietern durchzufüh-
ren, soweit hierzu Bedarf besteht. Die
Verhandlungsphase endet in jedem Fall
mit der Aufforderung an die Bieter zur Ab-
gabe eines letzten Angebotes.
Im Anschluss an das Verhandlungsge-
spräch oder ggf. weiterer Verhandlungs-
runden werden die beteiligten Bieter zur
Abgabe eines letzten Angebotes zu einem
für alle verbliebenen Bieter gleichlauten-
den Termin aufgefordert.
Das letzte Angebot der Bieter ist voll-
ständig, bedingungs- und vorbehaltsfrei
und fristgerecht in notariell beurkundeter
Form in einem verschlossenen Umschlag
oder Behältnis einzureichen.
Die Auswahl des Erwerbers erfolgt nach
Maßgabe der Kriterien, die mit der Auf-
forderung zur Angebotsabgabe bekannt
gegeben werden.
Nach Zuschlag wird das Grundstücksareal
an den erfolgreichen Bieter durch notariell
beurkundete Annahme des vom Bieter
eingereichten Angebotes veräußert. Die
Veräußerung wird unter Gremienvorbehalt
erfolgen.
Die Planungshoheit des Landes Berlin wird
durch den Zuschlag nicht eingeschränkt.
Das Land Berlin haftet insbesondere nicht

Bidders whose bids fulfil the formal and
content requirements of bid submission
will be invited to take part in negotiations,
during which bidders will debate and
negotiate the content of their bids.
The seller and the contracting authority
reserve the right to conduct additional
rounds of negotiation with bidders should
the need arise. In each case the nego-
tiation phase ends with a request to the
bidders to submit a final bid.
Following the negotiation meeting or, if
applicable, further rounds of negotiation,
all remaining bidders will be asked to
submit a final bid by a certain deadline,
applicable to all.
The final bid is to be complete and
unconditional, and submitted by the bidder
before the deadline in a sealed envelope or
package and in a format that has been
certified by a notary.
The purchaser is selected in accordance
with criteria that are announced at the
same time as the invitation to submit bids.
After the contract has been awarded, the
property will be sold to the successful
bidder; this will entail the acceptance of
the bid it submitted being certified by a
notary. The sale will take place under the
supervision of an authorised committee.
The State of Berlin’s ultimate planning
authority is not inhibited by the awarding
of the contract. The State of Berlin cannot
