agent and thus requires payment of a commission, which
depends on the knock down price, as well as other costs
and taxes. The payment due is added up as follows:
Knock-down price
+ 6 % commission fee
= Subtotal
+ V.A.T. according to § 12. II UstG (7 %)
= Subtotal
+ 1% insurance (plus 19% insurance tax)
= Total purchase price
With the knock down, the buyer also purchases insurance
(details: see front of the catalog). The insurance premium
is paid with the accounting for the auction. The sale is
concluded under §449 BGB (German Civil Code) with
reservation of proprietary rights by the vendor until all
payments are received in full.
A refund of V.A.T. will be initiated after verification of the
tax identification number and receipt of the export papers.
10. If the buyer acquires an approved stallion, he is obligated
to pay all costs associated with registration of this stallion
into the Stallion Book I (1,000.00 € including V.A.T.)
to the Trakehner Verband. This fee will be billed with the
auction invoice by the Trakehner Verband.
11. Risk is transferred to the purchaser, even though the
horse remains in the care of the Trakehner Gesellschaft
mbH or the vendor. This also applies if the vendor remains
the proviso owner.
The horses are handed over with a halter and lead rope
and must be collected immediately after the auction, at
the latest by 8 p.m. on the day of the sale. From that time
onwards, all further costs must be paid by the purchaser.
Transport and insurance offices are located on the premises.
Transport companies have special vehicles ready to
transport the horse to the purchaser’s stable.
Conditions of Sale
No horse may be removed from the premises until the
payment has been finally settled.
Horses sold at auction are on principle given to the purchaser
only against cash or a check endorsed by the bank.
If a horse has been sold on account, and the vendor does
not agree to hand over the stallion to the purchaser, the
vendor will take the horse back to his own stable at the end
of the day, the risks and costs to be borne by the purchaser,
until the full price has been paid to the Trakehner Gesellschaft
mbH, which will immediately inform the vendor
that the payment has been made. The horse may only be
removed from the premises after an exit vouched issued by
the auction office has been handed in.
12. The grooms or representatives of the vendor have to
look after the horses in compliance with chapter 11 and
should assist with the loading process This does not constitute
a contract between the buyer on one hand and the
consigner, the Trakehner Gesellschaft mbH or the groom
on the other hand. Losses acquired by the groom or the
consigner are the responsibility of the buyer, deliberate or
grossly negligent actions excluded.
13. Place of fulfillment for all contracts in addition to these
terms of sale is Neumünster. Place of jurisdiction is also
Neumünster.
14. If any or several of the conditions listed above should
become void, this will not affect any other conditions.
Conditions that have become void are to be replaced by
rulings that enable all parties to achieve their economic
goals in a legally effective and practicable manner.
